The agreement
These Terms of Service (“Terms”) form a binding agreement between you and HomeFinder WA (“HomeFinder WA,” “we,” “us”), the operator of adulthomefinder.com. By accessing or using the site, you agree to be bound by these Terms and our Privacy Policy. If you don't agree, please don't use the site.
What HomeFinder WA is (and isn't)
HomeFinder WA is an independent online directory of adult family homes (AFHs) in Washington State. We help families discover homes and pass their inquiries to home owners. We make our directory free for both families and owners.
We are not:
- A healthcare provider, care broker, or placement agency
- A real-estate agent, broker, or representative of any home or owner
- A guarantor of any home's quality, safety, licensing status, or fitness for any particular person
- A party to any contract, lease, admission agreement, or care agreement between a family and a home
Every adult family home listed on HomeFinder WA is licensed and regulated independently by the Washington Department of Social and Health Services (DSHS). Families bear sole responsibility for evaluating, touring, and selecting a home for themselves or their loved one.
Eligibility
You must be at least 18 years old to use HomeFinder WA. By using the site, you represent that you are 18 or older and have the legal capacity to agree to these Terms. If you're using the site on behalf of an organization, you represent that you have authority to bind that organization.
Your account
You're responsible for everything that happens under your account. Keep your credentials confidential. Use a strong, unique password. If you suspect unauthorized access, contact us right away. We may suspend or terminate accounts that violate these Terms or present risk to the platform or other users.
Special terms for owners
If you list an adult family home on HomeFinder WA, you represent and warrant that:
- You hold a current, valid Washington State adult family home license issued by DSHS, and the license number you provide is your own
- You will keep your listing information accurate, current, and not misleading
- You have the right to post every photo, description, and detail you upload, and that none of it infringes any third party's rights
- You will respond to family inquiries in a professional, lawful manner, and will not use HomeFinder WA to solicit business outside of your licensed AFH services
- You will comply with all applicable laws — including but not limited to Washington Administrative Code Chapter 388-76 (AFH licensing), DSHS resident-rights rules, the Fair Housing Act, the Americans with Disabilities Act, anti-discrimination laws, and tax law
- You will not provide HomeFinder WA with another individual's protected health information (PHI) through the platform
You alone are responsible for the relationships you form with families through the platform — including any tours, admission agreements, contracts, or care delivered. HomeFinder WA is not a party to those relationships.
Special terms for families
When you use HomeFinder WA to inquire about a home, you understand and agree that:
- HomeFinder WA does not vet, endorse, or recommend any home. We pass your inquiry to the owner; we don't evaluate suitability
- You will independently verify each home's license, references, and quality before making any decision
- You will not rely on HomeFinder WA listings, profiles, or descriptions as a substitute for visiting a home in person and speaking with the owner
- You will not share protected health information, social security numbers, financial account numbers, or other sensitive identifiers through our forms
- You take sole responsibility for the choices you make about care for yourself or a loved one
If you observe abuse, neglect, financial exploitation, or other mistreatment of a vulnerable adult, please report it directly to the Washington State End-Harm hotline at 1-866-ENDHARM (1-866-363-4276) or to your local Adult Protective Services. Do not report it through HomeFinder WA — we are not equipped to act on reports of harm.
Acceptable use
You agree not to:
- Use the site for any unlawful purpose, or to harass, threaten, or defraud any person
- Misrepresent your identity, the home you're associated with, your role, or your relationship to a family member or care recipient
- Scrape, crawl, or otherwise extract listings, contact information, or other content in bulk
- Send unsolicited commercial messages (spam), illegal solicitations, or marketing to owners or families you contact through the platform
- Probe, scan, or test the vulnerability of the site, or otherwise attempt to interfere with the service
- Post content that infringes intellectual property, defames anyone, invades privacy, or violates any law
- Upload viruses, malware, or other harmful code
- Use the platform to discriminate against any protected class in a manner that violates the Fair Housing Act, ADA, Washington Law Against Discrimination, or any other anti-discrimination law
Content you submit
You keep ownership of the content you submit (listing text, photos, messages, etc.). You grant HomeFinder WA a worldwide, non-exclusive, royalty-free license to host, display, reformat, and distribute your content as needed to operate, promote, and improve the service. This license ends when you delete your content from the platform, except (a) to the extent retention is required by law, (b) for backup copies we keep for a reasonable period, and (c) for any content you've already shared publicly that's been copied by third parties.
You represent that you own the rights to everything you upload, or have permission from the rights-holders to grant the license above.
Third-party services
The site may link to or rely on third-party services (DSHS lookup, Google sign-in, email delivery, map providers). HomeFinder WA is not responsible for the content, accuracy, privacy practices, or availability of any third-party service.
Disclaimers — no warranties
The site is provided “AS IS” and “AS AVAILABLE,” without warranty of any kind, express or implied.
To the maximum extent permitted by law, HomeFinder WA disclaims all warranties — including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability. We do not warrant that:
- Information in any listing is accurate, complete, current, or non-misleading
- Any home is licensed, safe, suitable, or available
- Any owner will respond to your inquiry, or do so in a particular timeframe
- The site will be uninterrupted, error-free, or secure against unauthorized access
- Defects will be corrected, or that the site is free of viruses or other harmful components
Your use of the site is at your sole risk.
Limitation of liability
To the maximum extent permitted by law, HomeFinder WA, its owners, employees, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your use of the site.
This includes (without limitation) damages for personal injury, wrongful death, abuse, neglect, financial exploitation, loss of profits, loss of data, loss of goodwill, or any other intangible loss — regardless of whether HomeFinder WA was advised of the possibility of such damages.
Because we provide the service free of charge, our maximum aggregate liability to you for any cause whatsoever — whether in contract, tort (including negligence), or otherwise — is limited to one hundred U.S. dollars ($100).
Some jurisdictions don't allow these limitations, in which case they apply to the maximum extent permitted by law.
Indemnification
You agree to defend, indemnify, and hold harmless HomeFinder WA, its owners, employees, agents, and service providers from any claim, demand, loss, damage, cost, or expense (including reasonable attorneys' fees) arising out of:
- Your use of the site
- Your violation of these Terms
- Your content, including any claim that your content infringes another person's rights
- (Owners) Any care provided or not provided to a resident referred to or contacted through HomeFinder WA, and any claim about the condition or operation of your home
- (Families) Any decision you make about a home or owner based on information you find on HomeFinder WA
Termination
You can stop using the site or delete your account at any time. We can suspend or terminate your access at any time, with or without notice, if we believe you've violated these Terms, presented risk to the platform or other users, or for any other reason in our reasonable discretion. The sections of these Terms that, by their nature, should survive termination (Content, Disclaimers, Limitation of Liability, Indemnification, Disputes) will continue to apply.
Disputes and governing law
These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-law rules. Any dispute arising out of or related to these Terms or the site shall be resolved exclusively in the state or federal courts located in King County, Washington, and you consent to personal jurisdiction there.
You and HomeFinder WA each waive any right to a jury trial. Any claim must be brought within one (1) year after the cause of action arises, or it is permanently barred.
You may not bring a claim as a plaintiff or class member in any purported class or representative action.
Changes to these terms
We may update these Terms from time to time. If we make material changes, we'll update the “Effective” date and, where appropriate, notify owners by email. Continued use after the effective date of an update constitutes your acceptance of the revised Terms. If you don't agree with a change, please stop using the site.
Miscellaneous
These Terms (together with the Privacy Policy) are the entire agreement between you and HomeFinder WA regarding the site, and supersede any prior agreements on the subject. If any provision is held unenforceable, the rest will remain in effect, and the unenforceable provision will be replaced by an enforceable one that most closely matches its intent. Our failure to enforce any right isn't a waiver of that right. You may not assign these Terms without our written consent; we may assign them freely.
